Place of service 53 is a Community Mental Health Center. Not simply a clinic that treats mental health — a CMHC is a defined facility type with statutory service obligations, and that definition is what determines whether the code applies.
To qualify, a centre generally has to provide outpatient services including specialised outpatient care for children, older adults, individuals with serious mental illness, and people discharged from inpatient psychiatric treatment; 24-hour emergency care; day treatment or partial hospitalization; psychosocial rehabilitation; and screening for patients being considered for admission to state mental health facilities. A practice that offers therapy but none of that infrastructure is an office — POS 11 — regardless of how it describes itself.
POS 53 is a facility place of service, and that single fact changes what the professional claim pays.
Medicare and most commercial payers price every service two ways. The non-facility rate assumes the clinician bears the overhead — the room, the staff, the equipment. The facility rate assumes a facility is billing separately for that overhead, so the professional claim covers only the clinician’s work. The facility rate is lower, sometimes substantially.
So billing POS 11 for a service delivered inside a CMHC claims the non-facility rate for overhead the practice did not carry. It pays more, which is exactly why it is a recurring audit finding. Use the RVU calculator to see the gap between the two rates for a given code — on psychiatric E/M and psychotherapy codes it is not trivial.
| Code | Setting | Key distinction |
|---|---|---|
| 53 | Community Mental Health Center | Community-based facility with 24-hour emergency care and PHP obligations |
| 11 | Office | Private practice location — non-facility rate |
| 52 | Psychiatric Facility Partial Hospitalization | PHP attached to or operated by a psychiatric hospital, not a CMHC |
| 51 | Inpatient Psychiatric Facility | Patient is admitted, not attending outpatient sessions |
| 71 | Public Health Clinic | State or local public health facility — different programme entirely |
| 10 / 02 | Telehealth | Patient at home (10) or another site (02) — never 53 |
The 52 versus 53 distinction catches people most often, because both deliver partial hospitalization. The question is not what service was delivered but what kind of entity delivered it: a programme run by a psychiatric hospital is 52, a community mental health centre is 53. Payers price and audit the two separately, so guessing is expensive.
Since behavioural health moved heavily to telehealth, this has become the most common POS 53 error.
Place of service describes where the patient was, not where the clinician was. A CMHC therapist delivering a session from their office at the centre to a patient sitting at home is POS 10 — telehealth provided in the patient’s home. It is not POS 53. Coding it 53 misstates the encounter and, since telehealth and facility rates differ, misstates the payment as well.
See mental health billing services for how we handle behavioural health claims, the full place of service code list, and the POS code decision tree if you are unsure which setting applies. For denials, CO-50 is the medical necessity denial behavioural health claims hit most often.
Compare: POS 52 — psychiatric facility, partial hospitalization. The deciding factor is the entity delivering the care, not the programme schedule.
The rest of the set: POS 51 — inpatient psychiatric facility, for patients who are formally admitted.
Correct place of service, clean PHP authorisation tracking and psychotherapy coding — we bill behavioural health practices across the United States.
